A number of dairies from Russia are planning to file a class action against a Chinese company from Mudanjiang. The fact is that this company has registered their trademarks in China and Russians will not be able to work in China under their brands.

According to RIA Novosti, at the end of 2018, an agreement was signed between China and Russia, according to which dairy plants can supply their products to neighboring countries. Russian companies received permits only at the end of the year, and in January the Chinese company registered trademarks on itself.

This is not an isolated case, Russian brands have several times left the Chinese partners, and to solve this issue in favor of the Russians was almost impossible. This case is remarkable, perhaps, only by the fact that the Chinese comrades carried out their financial maneuver against not just businessmen from Russia, but companies that acted within the framework of the agreement between the Rosselkhoznadzor and the General customs administration of China on the supply of dairy products, and even all this against the background of the fact that the President of Russia gifted the President of China with Russian ice cream, believes Alexey Simonov, partner of Asia Media global Agency.

The scheme for the appropriation of trademarks by Chinese business has already been worked out and tested, and not even on the Russians. Often, two simple ways are used – the official Chinese partner simply takes over all the exclusive rights and actually acquires more rights to the brand in China than its rightholder in the country of origin of the goods, while the joint work is built in the planned mode, everything suits everyone, and if any contradictions begin, the foreigner is surprised to learn that he did not take into account some nuances of Chinese legislation and in China he is no one. The second way is when a Chinese company itself imports goods into the country, and the manufacturer is not even going to officially enter the Chinese market, but when it gathers, it is surprised to learn that its brand is already working in full and there is nothing to be done about it.
