Our company’s team submits our prospective customers for catching up on our client’s actual patent dispute held at current. All of the documents scanned are published with consent of “BANSKO INTERIOR DOORS” OOD. The dispute emerged in the Republic of Bulgaria. The origin of dispute comes down to the fact that two companies registered patent rights on similar interior doors in a short timespan, while Bulgarian Patent Office is not obliged to verify brand new industrial design patents with those already registered.
The dispute’s input information is given below.
“BANSKO INTERIOR DOORS” OOD placed the industrial design patent registration request to the Patent Office of Republic of Bulgaria on July 07, 2019, patent №8863. The patent contains 7 interior doors industrial designs. Scanned copies are given below.
A while after, patent rights on similar industrial designs have been registered in favor of “REZERVTORG – IT” OOD: registration date August 2, 2019, №8880, №8881, №8882.
A follow-on reclamation from “BANSKO INTERIOR DOORS” OOD to “REZERVTORG – IT” OOD was issued to put on hold on using the “BANSKO INTERIOR DOORS” OOD owned patent rights by the latter. However, “REZERVTORG – IT” OOD hasn’t admitted the fact of using the property of others.
As a result, “BANSKO INTERIOR DOORS” OOD has applied to Bulgarian Patent Office with a complaint on its patent infringement. The Patent Office’s official reply boils down to admitting just one fact that “BANSKO INTERIOR DOORS” OOD patent rights registration had happened prior to the one of “REZERVTORG – IT” OOD, and recommends “BANSKO INTERIOR DOORS” OOD to submit a petition for nullifying the patents owned by “REZERVTORG – IT” OOD.
On the surface it may seem strange to our clients how could it have happened that two companies registered patent rights on similar designs. But the answer is simple: the Patent Office does not verify the design’s identity during the registration proceeding. Therefore, the patent rights’ initial owner in this case is under compulsion of putting a petition for striking the infringing patents off the register and paying up all the related registration fees.
By now, “BANSKO INTERIOR DOORS” OOD has filed a petition to the Patent Office of Republic of Bulgaria for nullifying the patents owned by “REZERVTORG – IT” OOD.
